1. PRICES
The prices indicated on our site are in Euros and include VAT. The delivery costs are shown as the customer chooses a product and are invoiced at the end of the order in addition to the price of the products.
We reserve the right to modify our prices at any time but will apply the current rates as indicated to you on the site at the time the order was placed.
We would like to inform you that, if an obviously incorrect price appears on our website (a price that is clearly too low, for example), and for whatever reason (IT bug, human error, technical error etc.), your order will be cancelled, even if it has been initially validated.
2. AVAILABILITY
Please note that we will honour your order while stock is available.
In the event where one of the products ordered is not in stock, we will contact you before the order is dispatched. With your agreement we can deliver the products in stock and forward the balance of the order when the stock becomes available. You have the option to cancel the unavailable product and we can reimburse you for it.
3. DELIVERY
Delivery is calculated on the basis of the product size and ranges from €5.50 to €12.50.
You will automatically receive confirmation of your order by email. In most cases your order will be dispatched within 24 – 48 hours. You will receive an email confirmation that your order has been processed and dispatched. We will contact you if there is any delay with fulfilling the order.
We cannot, however, be held responsible for the consequences of a late delivery or the loss of a package caused by a third-party contracted to make delivery, or by you, or because of some unforeseen event or an Act of God.
When you receive the goods, we recommend that you check the products against the order that you placed with us and notify us immediately if there are any problems.
For security reasons, all orders paid by credit or debit card are verified by Niamh Barrett Computers Ltd. Additional information may be requested, or demanded, in order to validate your purchase. Furthermore, for any order above the amount established by Niamh Barrett Computers, a piece of identification as well as proof of address will be requested and should be sent via fax, post, or email. We apologise for any inconvenience this may cause, however these measures are taken to protect our customers from possible fraud associated with bank cards.
We only deliver to addresses in the Republic of Ireland.
4. RIGHT OF RETURN
Niamh Barrett Computers Ltd allows you 7 working days to return a product that you are not satisfied with. You can return the product within this time period, at your own expense, accompanied by your invoice and a completed and signed return goods voucher.
We request that you send us the merchandise by registered post and that you purchase insurance with the carrier for the value of the merchandise. This is notably necessary should they lose or damage the goods. Shipping fees remain the customer’s responsibility.
The present right of return only applies to products that are returned in their original, complete packaging (accessories, user guide etc.), and in working condition. Any product that has been damaged, or is not in its original packaging or packaging that has been worn beyond simply opening the product will not be refunded.
We do not take back Ink Cartridges which have been opened so please check carefully that’s it the correct cartridge before you purchase it .
If the product is returned within 7 days of its delivery (the post mark being proof thereof), the Customer will be reimbursed by bank transfer if payment was made by bank card, or by cheque in other cases. Reimbursement will usually be made within 5 days other than in circumstances where tests need to be conducted on the product.
The right of return does not include opened Ink Cartridges, opened Software or new printers where cartridges have been opened and installed.
5. PRODUCT WARRANTY
In the case of defects or faulty workmanship in products or any parts thereof supplied but not manufactured by Niamh Barrett Computers Ltd, the Customer shall not be entitled to receive any greater benefit here under than that shall be received by Niamh Barrett Computers Ltd under any guarantee or warranty given to Niamh Barrett Computers Ltd by the manufacturers or suppliers thereof.
Under warranty Niamh Barrett Computers Ltd will as its option either repair or give replacement of equivalent quality or issue credit to the Customer for any goods found to be defective because of poor workmanship provided that
a) Niamh Barrett Computers Ltd is notified in writing within 7 days of The Customer first uncovering such defects
b) The Goods have been used in an appropriate manner and/or as prescribed in the operating instructions(if any)
c) The defective goods are returned to Niamh Barrett Computers Ltd at the Customers expense
d) Examination by The company of such goods discloses to its satisfaction that such defect exist and have not been caused by misuse, neglect, accident, improper storage, installation or handling or by repair or alteration not effected by Niamh Barrett Computers Ltd
e) The Goods not having been modified or repaired otherwise than by Niamh Barrett Computers Ltd or otherwise interfered with and
f) The Customer shall pay to Niamh Barrett Computers Ltd the cost (as certified by Niamh Barrett Computers Ltd) of any examination of such Goods as a result of which The Company denies responsibility.
6. PROTECTION OF PERSONAL DATA
Since the details you give us are essential for the processing and delivery of orders, for billing and for the establishment of warranty contracts, failure to provide these details will result in the cancellation of your order.
By registering on the Site, you agree to provide us with sincere and true information as it concerns you. Communicating false information is contrary to the present General Terms and Conditions.
7. GENERAL
These Terms and Conditions govern the use of our website. Both parties ie Niamh Barrett Computers Ltd and the Customer accept these conditions unreservedly.
These general terms and conditions are the only conditions that are applicable and replace all other conditions.
We maintain that, by confirming your order, you unreservedly accept these general terms and conditions of sale.
Intellectual property
All the content on the Niamh Barrett Computers website (illustrations, texts, names, brand names, images and videos) is the property of Niamh Barrett Computers, its suppliers or partners. Any partial or total reproduction of this content, by any means and on any support, is subject to prior and express authorisation by Niamh Barrett Computers Ltd.
Disclaimer
The information contained in the Website is for information purposes only and, although we have made every effort to ensure the correctness of the information contained herein, the information available through the Website is provided “as is” and “as available” and without warranties or conditions of any kind either expressed or implied. We accept no liability in relation to any of the above other than as may be provided for under your statutory rights.
General
We shall not be liable for any failure to perform any of our obligations under these Terms and Conditions which is caused by circumstances beyond our reasonable control including, but not limited to, any force majeure incident.
Our failure to exercise or enforce any right or provision of the Terms and Conditions shall not constitute a waiver of such right or provision unless acknowledged and agreed by us in writing.
Laws
The Terms and Conditions shall be governed by and construed fully in accordance with the laws of the Republic of Ireland. You and we agree to submit to the exclusive jurisdiction of the courts located in the Republic of Ireland. If any provision(s) of the Terms and Conditions is held by a court of competent jurisdiction to be contrary to law, then such provision(s) shall be construed, as nearly as possible, to reflect the intentions of the parties with the other provisions remaining in full force and effect.
Limitation of Liability
To the fullest extent permitted by applicable law, under no circumstances, including, but not limited to, negligence, shall Niamh Barrett Computers Ltd be liable to you for any direct, indirect, incidental, special or consequential damages that result from the use of or the inability to use the Website, any changes to the Website or any material or data sent or received or not sent or received.
Termination
We may terminate the Website with or without cause at any time and effective immediately. In addition, we, in our sole discretion, may terminate your Account for violation of the letter or spirit of these Terms and Conditions.
